TERMS OF SERVICE

These Terms of Service (“Terms”) govern your purchase and use of services provided by Guard Profit (“Guard Profit,” “we,” “us,” or “our”). By purchasing, subscribing to, or using Guard Profit services, you acknowledge that you have read, understood, and agreed to these Terms.

1. Services

Guard Profit provides profitability consulting, reporting, business insights, and related support intended to help service-based businesses better understand their financial performance and make informed business decisions.

The specific services, reports, recommendations, frequency of communication, and other deliverables may vary depending on the service purchased and information provided by the client.

2. Monthly Subscription

The Guard Profit Monthly service is currently offered at $499 CAD per month.

The subscription is recurring. By subscribing, you authorize the payment method provided at checkout to be charged $499 CAD each month, plus any applicable taxes, until the subscription is cancelled.

Guard Profit may change its pricing or services in the future. Any price change affecting an existing subscription will be communicated as required before the new price takes effect.

3. Cancellation

You may cancel your recurring subscription to prevent future renewal charges. Cancellation applies to future billing periods and does not retroactively cancel charges already processed.

Unless otherwise stated, access to services already paid for may continue through the applicable paid billing period.

4. NO-REFUND POLICY

ALL PAYMENTS TO GUARD PROFIT ARE FINAL AND NON-REFUNDABLE, EXCEPT WHERE A REFUND IS REQUIRED BY APPLICABLE LAW.

Because Guard Profit provides professional services, analysis, business support, and access to ongoing services, no refunds, partial refunds, credits, or prorated refunds will be provided for amounts already charged, including where a client cancels during a billing period or does not fully use the services available during that period.

Clients are responsible for cancelling their subscription before the next renewal date if they do not wish to be charged for another billing period.

Nothing in this section limits any rights or remedies that cannot legally be excluded under applicable consumer-protection or other laws.

5. Client Responsibilities

You are responsible for providing accurate, complete, and timely information reasonably necessary for Guard Profit to provide its services.

The usefulness and accuracy of analysis or recommendations may depend on the accuracy and completeness of the information you provide.

You remain responsible for all final business, operational, financial, and management decisions.

6. No Guarantee of Results

Guard Profit works to provide useful profitability insights and business support; however, we do not guarantee any particular increase in revenue, profit, savings, business performance, or other financial result.

Business outcomes depend on numerous circumstances outside Guard Profit's control, including market conditions, expenses, pricing, management decisions, competition, customer demand, and implementation.

7. Not Accounting, Tax, Legal, or Investment Advice

Unless expressly agreed otherwise in writing, Guard Profit's services are provided for general business and profitability consulting purposes.

Guard Profit does not provide legal, tax, accounting, investment, securities, or regulated financial advice. You should consult an appropriately qualified professional when advice in one of those areas is required.

8. Confidentiality

Guard Profit will use reasonable care when handling confidential business information provided in connection with the services.

Clients should not provide passwords, payment-card credentials, or other sensitive authentication information unless specifically required through an appropriate secure system.

9. Intellectual Property

Unless otherwise agreed in writing, Guard Profit retains ownership of its proprietary methods, templates, processes, materials, branding, and other intellectual property.

Clients may use reports and materials specifically provided to them for their own internal business purposes.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Guard Profit will not be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, lost opportunities, or business interruption arising from use of the services.

To the extent permitted by applicable law, Guard Profit's aggregate liability relating to a claim will not exceed the amount the client paid to Guard Profit for the service giving rise to the claim during the three months immediately preceding the event giving rise to the claim.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

11. Third-Party Services

Guard Profit may use or provide links to third-party platforms, including payment-processing and website services. Those third parties operate under their own terms and privacy practices, and Guard Profit is not responsible for their independent services or systems.

12. Changes to These Terms

Guard Profit may update these Terms from time to time. The current version will be posted on the Guard Profit website with an updated effective date.

Changes will apply prospectively except where otherwise permitted or required by law.

13. Governing Law

These Terms are governed by the laws of the Province of Alberta and the applicable federal laws of Canada, without regard to conflict-of-law principles.
